Panama City airport files US$20mn lawsuit ag… – BNamericas English

Panama City’s Tocumen international airport (AITSA) filed a lawsuit against CNO – previously called Constructora Norberto Odebrecht – for failing to deliver terminal 2 construction works on time. 
According to an AITSA press release, the airport is demanding at least US$20.7mn in damages. 
“Tocumen bases its claim on current and future expenses, which include fines for the delay, supervision costs, security and staff expenses, among others. The claim also includes damages for loss of earnings from renting commercial premises due to failure to deliver the works on time,” states AITSA.
The 116,000m2 terminal 2 expands passenger capacity of Tocumen from 12mn to 25mn per year. Odebrecht won the tender in 2012 with a US$679mn bid, which was the lowest amount in contest. 
Construction started in 2013 and was due to be ready in 2017 but the project was delayed several times and its cost rose to more than US$900mn.
The government terminated Odebrecht’s contract in 2021 for failing to deliver the works, a decision contested by the company which denied that it was in breach of contract and said the terminal was 99.9% built.
The government took over to finish the remaining works and the terminal was opened on June 22 this year.
